Local Nuisance Exemptions
Under section 19 of the Local Nuisance and Litter Control Act 2016 Council is able to consider an exemption from local nuisance-causing activities upon application. Exemptions may be reasonable for short-term activities such as festivals, events or major construction activities where some level of noise, dust, odour or other local nuisance is likely to be unavoidable.
Applications must, however, be accompanied by a nuisance management plan describing the steps that will be taken to prevent, minimize or address any adverse effects on the amenity value of the area concerned and also describing the exceptional circumstances that exist to justify the granting of an exemption.
An application for an exemption should be made two (2) weeks prior to commencing the activity. Staff will endeavor to process the application as quickly as possible. Where less than two weeks' notice is given, staff cannot guarantee that the application will be processed.
As part of the process, you are required to consult with residents/businesses in your local community. You must advise them in writing of your intended works, the dates/times and the possible effects.
Upon granting an exemption, Council can apply strict conditions to ensure that an applicant does everything reasonable to minimise the impact of the nuisance.
An exemption granted by Council may be unconditional or subject to conditions, including (but not limited to) conditions relating to:
- the permitted times or periods of time for carrying on the activity
- the manner of carrying on the activity.
A declaration for exemption by the Council has effect from the date specified in the declaration and remains in force according to its terms for a period not exceeding 3 months, or until revoked by the council. The council may, by further notice in writing, vary or revoke a declaration it has made.

Please note an Application fee of $150.00 applies, pursuant to Council’s Fees and Charges Register 2026/2027 and shall be charged upon lodgment of the application.

Declaration Register of Local Nuisance Exemptions
NOE/19/2026 - Township main streets within the Council Boundaries of Nuriootpa, Mount Pleasant, Williamstown, Angaston and Tanunda
The exemption applies for the period Friday 31 July 2026 to Friday 23 October 2026, for the following hours:
• Mondays - 5.15 am to 7.00 am
o Murray Street Nuriootpa - Creek Line to Penrice Road
o Gawler Street Nuriootpa - Murray Street to Barossa Street
• Tuesdays - 5.15 am to 7.00 am
o Melrose Street Mount Pleasant - Pentelows Road to Tungkillo Road
• Wednesdays - 5.15 am to 7.00 am
o Queen Street Williamstown - 15 Queen Street to 4 Mount Crawford Terrace
• Thursdays - 5.15 am to 7.00 am

NOE/20/2026 - Lot 1 Kalperri Road Sandy Creek - Commissioning of the new Sandy Creek water tanks, the new pipeline will be connected to the existing trunk mains between Kalperri Road and Kalbeeba Road
The exemption applies for the period 25 and 26 August 2026 and 1 and 2 September 2026, for the following hours:
- 6.00 pm to 7.00 am (Tuesday to Wednesday)
NOE/12/2026 - 261 Hoffnungsthal Road Lyndoch - Barossa Rodeo Event held on private land of Barossa Helicopters, including site bump-in and site bump-off
The exemption applies for the period 13 November 2026 to 15 November 2026, for the following hours:
- Between 4.00 pm to 10.00 pm, Friday - site bump-in
- Between 7.00 am to 11.00 pm, Saturday - event operations, gates open to the public between 12 noon to 9.00 pm
- Between 7.00 am to 2.00 pm, Sunday - site bump-out
NOE/17/2026 - Gembrook Residential Development - 168 Menge Road Tanunda - Civil works associated with site preparation, earthworks, road construction, drainage and utility installation
The exemption applies for the period 31 August 2026 to 30 November 2026, for the following hours:
- 6.30 am to 7.00 am (Monday to Saturday), with works permitted between 6.30 am to 7.00 pm
NOE/22/2026 - Lot 1 Kalperri Road Sandy Creek - Overseeing the filling of the new Sandy Creek water tanks, involving light vehicles only and no heavy plant
The exemption applies for the period Sunday 30 August 2026 and Sunday 6 September 2026, for the following hours:
- 7.00 am to 5.00 pm (Sunday)
